Resolution 253-21 A Resolution to Declare a Vacancy on the Tribal Council and Call for a Special Election. The foregoing resolution was duly approved on July 20, 2021, by a vote of 7 for 0 against and 0 abstaining. Resolution 254-21 A Resolution to Modify the Mandate to Wear Face Coverings to Slow the Spread of COVID-19. WHEREAS, according to the CDC website noting locations with a substantial or high rate of transmission, all the counties where CRIT is located, as well as all the counties border- ing CRIT are in an area with a high rate of transmission; and WHEREAS CRIT's consulting physician, Dr. Dwivedi, supports requiring face masks be worn indoors by anyone regardless of vaccination status; and WHEREAS positive cases of COVID-1 9 continue to be reported within the Colorado River Indian Reservation and surrounding communities. NOW THEREFORE BE IT RESOLVED by the Tribal Council of the Colorado River Indian Tribes to mandate the wearing of face cov- erings by ail persons on the Colorado River Indian Reservation, whether fully vaccinated or not, in any indoor location outside of one's home; and BE IT FURTHER RESOLVED businesses (located within the Colorado River Indian Reservation tribal lands shall continue to ensure staff and customers use face coverings within their establishments, including the conspicuous posting of this requirement; and BE IT FURTHER RESOLVED that all persons, regardless of vaccination status, face coverings are not required outdoors except when attend- ing crowded outdoor events where physical distancing cannot be maintained, such as live performances, parades, fairs, festivals, sports events, or other similar settings. BE IT FURTHER RESOLVED that a face cover- ing or mask must completely cover the nose and mouth; and BE IT FURTHER RESOLVED that the following individuals are exempt from wearing face coverings always: 1) Persons two years old and younger; and 2) Persons with a medical condition, mental health con- dition, or disability that prevents them safely wearing a face-covering, including persons with a medical condi- tion for whom wearing a face-covering could obstruct breathing or who is unconscious, incapacitated, or other- wise unable to remove a face covering without assis- tance; and 3) Persons who are hard of hearing or communicating with a person who is hearing impaired, where the ability to see the mouth is essential for communication; and 4) Persons who are wearing a face covering would create a risk to the person related to their work, as determined by local, state, or federal regulators or workplace safety guidelines. BE IT FURTHER RESOLVED that the fol- lowing specific settings are exempt from face-covering requirements: 1) Persons in a car alone or solely with members of their household. 2) Persons who are working alone in a closed office or room. 3) Persons obtaining medical, dental, or cosmetic servic- es where removal of face-covering is necessary to per- form the service. 4) Persons who are incarcerated. 5) Workers who wear respiratory protection; and 6) Persons are not required to wear a mask indoors in public places while eating or drinking. BE IT FURTHER RESOLVED those businesses that fail to take measures to implement this mandate could be subject to sanctions including enforcement under the penalties of Resolution No. 54-20 for intentional viola- tions or enforcement through lease and business license requirements; and BE IT FURTHER RESOLVED that this Resolution shall take effect August 9, 2021, and shall remain until Tribal Council, in consultation with public health officials, determines that the threat has decreased or increased, and the mandate needs to be further modi- fied; and BE IT FURTHER AND FINALLY RESOLVED the Tribal Council Chairwoman and Secretary, or their designated representatives, are hereby authorized and directed to execute all documents necessary to imple- ment this Resolution. Resolution 255-21 A Resolution to Approve Extending Resolution No. 110-21 Implementing Phase Three to Lift COVID-19 Mitigation Measures to Fully Re-Open the Colorado River Indian Tribes. The foregoing resolution was duly approved on August 31, 2021, by a vote of 3 for 2 against and 0 abstain- ing. Resolution 256-21 A Resolution to Approve Exhibit A to the Agreement Among the United States of America, through the Department of Interior, Bureau of Reclamation, the State of Arizona, through the Arizona Department of Water Resources, the Central Arizona Water Conservation District, and the Colorado River Indian Tribes to Fund the Creation of the Colorado River System Water Through Voluntary Water Conservation and Reductions in Use During the Calendar Years 2020-2022 for Calendar Year 2022. WHEREAS CRIT holds entitlements to Colorado River water in the States of Arizona and California as specified in the Consolidated Decree of the Supreme Court of the United States in the case of Arizona v. California, et al., entered March 27, 2006 (547 U.S. 150), as it may be further modified ("Consolidated Decree"); and WHEREAS CRIT approved an Agreement Among the United States of America, through the Department of the Interior, Bureau of Reclamation, the State of Arizona, through the Arizona Department of Water Resources, the Central Arizona Water Conservation District, and the Colorado River Indian Tribes to Fund the Creation of Colorado River System Water Through Voluntary Water Conservation and Reductions in Use During Calendar Years 2020-2022 ("Agreement"); and WHEREAS the Tribes must submit a listing of all lands to be fallowed and technical memos calculating the divisions and consumptive use reductions, including a map of the parcels annually in July for the lands to be fallowed in the upcoming year pursuant to the terms of the Agreement. NOW. THEREFORE. BE IT RESOLVED by the Tribal Council of the Colorado River Indian Tribes, that Exhibit A to the Agreement, which is attached hereto and contains a listing of all lands to be fallowed and technical memos calculating the diversions and consumptive use reduc- tions, including a map of the parcels for the calendar year 2022, is hereby approved and incorporated into this Resolution; and BE IT FURTHER RESOLVED that Exhibit A may be subject to revisions upon Bureau of Reclamation and Arizona Department of Water Resources review and provided those revisions are de minimis and Exhibit A remains substantively similar it will not require to be approved again by Resolution. Resolution 257-21 A Resolution to Authorize the Submission of a Grant Proposal and Application for the Fiscal Year (FY) 2022 (October 1, 2021 – September 30, 2022) for the Grant Program titled Performance Partnership Grant (PPG) to Include the Programs of Clean Water Act (CWA) Section 106 and Non-Point Source (NPS) 319, FIFRA (Pesticides) and General Assistance Program Grant (GAP) to the United States Environmental Protection Agency, Region 9 Grant #BG-99T12720-3. WHEREAS, the Colorado River Indian Tribes is eligible for funding from the U.S. Environmental Protection Agency (EPA) Region 9 under the CFDA 66.605; and WHEREAS, funding under this grant opportunity will allow the Tribe to build tribal environmental program capacity under the Performance Partnership Grant (PPG) program and to improve the monitoring and management of water quality Clean Water Act §106/§319 Non-Point Source (NPS) activ- ities within the Reservation boundaries and under the Tribes' Environmental Protection Office (EPO); and to improve the management/administration of the EPO under the General Assistance Program (GAP) and for the development of an air toxics monitoring pro- gram as well as the monitoring of solid waste removal, standard setting, enforcement, etc.; and compliance assis- tance, worker protection standards, monitor the tracking system of applications (1080 Report) and ensure the enforcement of the agriculture codes on the Reservation under the FIFRA (Pesticides) Program; and WHEREAS it is the interest of the Tribe to build/maintain tribal capacity for the protection of the environment and par- ticipate in the planning, developing, and implementing tribal environmental protection programs policy-mak- ing, standard-setting, and direct implementation activ- ities potentially affecting tribal environmental interest to include development of an air toxics monitoring pro- gram; and direct application activities involving tribal ecological claims; and WHEREAS anticipated grant awards for one fiscal year per program and per fiscal year, for the CWA/NPS Program approximately up to $95,000.00, GAP Program approximately up to $178.642.00, and the FIFRA (Pesticide) Program approximately up to $80,200.00; will be made to the GRIT EPO under this funding opportunity; and WHEREAS this funding level will allow EPO to contin- ue to fund a percentage of anticipated allocated salaries per fiscal year from the CWA/NPS Program, the wages of the Water Quality Specialist (1.0 FTE) and Environmental Technician (0.50 FTE) for a total of 1.50 FTE, from the GAP Program the salary of the EPO Director (0.50 FTE), Administrative Assistant (0.60 FTE), Air Quality Specialist (0.50 FTE) and the Environmental Technician (0.25 FTE) for a total of 1.85 FTE, and from the FIFRA (Pesticide Program) the Pesticide Officer (1.0 FTE) and the Pesticide Inspector (0.40 FTE) total of 1.40 FTE; for a total of 4.5 FTE; and will allow EPO to plan, develop, implement, and build the CRIT Tribal CWA/GAP/RFRA Programs, allow for required travel for training opportunities and allow for the purchase of any program materials and sup- plies.
